Optus 'No Risk Switch' offer stands

The Federal Court of Australia has cleared the way for Optus's mobile marketing campaign 'No Risk Switch' to continue.

Paul Kitchin, Director Mobile Marketing for Optus, said that Telstra's attempt to block Optus's innovative mobile phone campaign had failed and the campaign would continue. "The Federal Court has not prevented us from offering 'No Risk Switch' or using the words 'no risk' despite Telstra's efforts," Mr Kitchin said.

With the advent of MNP, Optus decided not to impose a fee for customers choosing to change mobile service provider.

Under the No Risk Switch offer, Optus will not charge mobile customers a penalty if they switch to Optus - and then decide to leave within 10 days.

"In accordance with the Court's decision we will be making relatively minor adjustments to the wording of advertisements about the 'No Risk Switch' offer to ensure that consumers realise that another carrier may require them to honour outstanding contract issues," Mr Kitchin said.

He said the challenge to the Optus offer reflected competitive sensitivity.

"Our No Risk Switch is an unique offer in the marketplace and we think it must be hurting Telstra.

"Telstra is the only carrier to charge a porting fee for customers leaving them," he said.

"In stark contrast, the contract cancellation fees we would normally charge are waived if the customer decides to leave within 10 days - no penalties from Optus, no questions asked. It is a genuine customer offer".

The Optus No Risk Switch is available until 31 December 2001.
